COBRA generally applies to all private sector group health plans maintained by employers that had at least 20 employees on more than 50 percent of its typical business days in the previous calendar year.

Texas law allows employees of smaller fully insured employers (fewer than 20 employees) to keep the same group health insurance coverage for up to nine months after the loss of a job or loss of coverage because of a reduction in work hours. Texas also allows TSC for up to six months post-COBRA.
